These Terms of Use (the "Terms") govern access to and use of the MissRoll website and application (the "Service"), operated by Thomas Gouvrillon, an independent sole proprietor based in Québec, Canada (the "Operator"). By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use the Service.
MissRoll is an online platform for creating and playing tabletop role-playing games: game and character creation, scene management, text chat and dice rolling, live audio and video streaming, and a music library.
Use of the Service is restricted to individuals who are at least 18 years old. By creating an account, you represent and warrant that you are at least 18 years old. The Operator reserves the right to suspend or delete any account it discovers belongs to a minor.
You are responsible for the accuracy of the information provided when registering, as well as for keeping your password confidential. MissRoll offers a free version with limited access to features, as well as a paid subscription at $4.99 USD per month granting access to all features.
Payments are processed by our provider, Stripe, Inc. MissRoll does not collect or store your payment card details.
The subscription automatically renews at the end of each period unless cancelled before the renewal date from your profile. No prorated refund is granted for a period already started, except where required by applicable law in your jurisdiction.
If you reside in the European Union or the European Economic Area, you are generally entitled to a 14-day withdrawal period for online purchases. By subscribing and requesting immediate access to the digital content, you acknowledge and expressly agree to waive this withdrawal period.
You retain all rights to the content you create or upload on MissRoll (characters, images, albums, chat messages, etc. — "User Content").
By posting User Content, you grant the Operator a non-exclusive, worldwide, royalty-free licence to host, display and transmit that content solely to the extent necessary to operate the Service.
You are solely responsible for the User Content you post and warrant that you hold the necessary rights to it. In particular, you may not post:
Audio and video streams exchanged between players through MissRoll (powered by our provider Stream.io) are transmitted in real time and are neither recorded nor stored by MissRoll. You agree to behave respectfully toward other users during these sessions and not to record another user without their prior consent.
The MissRoll name, its logo, and all technical and visual elements of the Service, excluding User Content, are the property of the Operator and are protected by applicable intellectual property laws. Unauthorized reproduction is prohibited.
The Operator may suspend or terminate your access to the Service, with or without notice, in the event of a breach of these Terms. You may also delete your account at any time from your profile.
The Service is provided "as is" and "as available", without warranty of any kind, express or implied.
To the fullest extent permitted by applicable law, the Operator shall not be liable for any indirect, incidental or consequential damages arising from the use or inability to use the Service. The Operator's total liability, if any, is limited to the amount you paid over the preceding twelve months.
These Terms are governed by the laws of the Province of Québec and the federal laws of Canada applicable therein, without regard to conflict of law principles. Subject to any mandatory consumer protection rights you may have under the laws of your country of residence, any dispute shall be submitted to the exclusive jurisdiction of the courts of Québec.
The Operator may modify these Terms at any time. Any material change will be notified to you by email or through a notice on the Service. Continued use of the Service after changes take effect constitutes acceptance of those changes.
